These Terms of Service (the "Terms") are a binding agreement between you and Speedway Riders NYC ("Speedway Riders", "we", "us" or "our"), an online retailer of electric scooters, electric bikes, parts and accessories headquartered in Austin, Texas. They govern your use of speedwayridersnyc.com (the "Site") and every purchase you make through it.

By using the Site, creating an account or placing an order, you confirm that you have read these Terms, that you understand them, and that you agree to be bound by them together with our Privacy Policy, Shipping Policy, Returns and Exchanges Policy and Warranty page, each of which is incorporated here by reference. If you do not agree, please do not use the Site or place an order.

We sell online only. We do not operate a showroom or retail store, and nothing on the Site should be read as an invitation to visit one.

You must be at least 18 years old and able to enter into a binding contract to place an order. By ordering you confirm that you are. If you are buying an electric scooter or electric bike for a younger rider, you are responsible for choosing a model that is appropriate for their age and size, for supervising its use and for making sure it is ridden legally.

We ship to addresses in the 48 contiguous United States. Orders with billing or shipping details outside that area, or that we cannot verify, may be cancelled and refunded.

We may refuse, limit or cancel any order at our discretion, including where we suspect fraud, resale in breach of a manufacturer's dealer terms, or a breach of these Terms. If we do, any payment you have made will be refunded in full.

We are an authorized dealer for the brands we list. Product names, specifications, images and descriptions come from the manufacturers and are reproduced in good faith, but we do not guarantee that every listing is complete, current or free of error.

Figures such as top speed, range, motor power, climbing grade and weight capacity are the manufacturer's ratings, measured under the manufacturer's own test conditions. Real-world results depend on rider weight, terrain, temperature, riding mode, tire pressure and battery age, and will usually be lower. Range in particular varies widely and should be treated as a maximum, not a promise.

Colors may look different on your screen than in person, and manufacturers change components, firmware and cosmetic details between production runs without notice. Where a change is material we will tell you before shipping and give you the option to cancel.

All products are subject to availability. If an item you have ordered is out of stock or discontinued we will contact you with the option of a comparable model, a wait, or a full refund.

All prices are in US dollars and exclude any applicable sales tax, which is calculated and shown at checkout based on your shipping address. We may change prices at any time, but a change will not affect an order we have already accepted.

Sale prices, coupon codes and promotions are valid only for the period and on the terms stated, cannot be applied to earlier orders, and cannot be combined unless we say otherwise. Codes must be applied at checkout before the order is placed; we cannot apply them afterwards. We may withdraw or modify a promotion at any time.

Despite our best efforts, a small number of listings may carry an incorrect price or description. If we discover an error in an order you have placed, we will contact you with the correct information and the choice to proceed at the correct price or to cancel for a full refund. Where a price is so obviously wrong that a reasonable person would recognise it as a mistake, we may cancel the order and refund you without prior contact.

When you place an order you will receive an email confirming that we have received it. That email is an acknowledgement, not an acceptance. Our acceptance of your order, and the contract between us, is formed when we ship the item and send you a shipping confirmation. Until then we may decline the order for any reason set out in these Terms, and we will refund any payment taken.

We may verify your identity, payment method or address before accepting an order and may ask you for supporting information. If we cannot complete verification within a reasonable time the order may be cancelled.

If you need to cancel an order, contact us as soon as possible. We can normally cancel and refund any order that has not yet been dispatched. Once an item has shipped it cannot be cancelled; it can be returned under the Returns and Exchanges Policy if it qualifies.

We accept major credit and debit cards, PayPal and other payment methods shown at checkout. By submitting a payment method you confirm that you are authorized to use it. Payment is taken when the order is placed. Card details are handled by our payment processors and are never stored by us.

Financing is offered at checkout through Affirm, Klarna, Afterpay and PayPal. Each is an independent provider and lender, not part of Speedway Riders. Your eligibility, the plans offered, any interest rate and every other term of a financing agreement are set by the provider and governed by that provider's own agreement with you, which you should read before accepting. We do not make credit decisions and cannot change a provider's decision or terms.

Financing is available on orders up to $5,000. Any balance above that amount must be paid by another method at checkout. Where a financed order is returned, the refund is issued to the financing provider, which then adjusts or cancels your plan under its own terms; you remain responsible to the provider for any instalments that fall due before that adjustment is made.

Standard shipping is free on every order to the 48 contiguous United States. Orders are typically processed and dispatched within 1 to 2 business days of payment confirmation, and longer during major sales and holiday periods, by FedEx or UPS. Delivery estimates are estimates, not guaranteed dates, and carrier delays, weather and address problems are outside our control. Full details are in our Shipping Policy.

You are responsible for giving us a complete and accurate delivery address. Orders returned to us because of an address error, a refused delivery or repeated failed delivery attempts may be subject to the carrier's return charges before they can be reshipped or refunded.

Title to and risk of loss for an item pass to you when the carrier delivers it to the address you provided. Please inspect the outer packaging on delivery and the contents within 48 hours. If anything arrives damaged or will not power up, tell us within 12 hours of delivery with photographs of the box and the item. That short window is what the carriers give us to raise a claim, and reporting promptly is what lets us replace or refund quickly. Please accept a damaged delivery and document it rather than refusing it, unless we have told you otherwise.

You have 14 days from delivery to start a return or exchange of an unused, unridden electric scooter or electric bike in its original packaging with all accessories and paperwork, or of an accessory that is still sealed. Contact us first for an RMA number; returns received without one cannot be processed. Once an item has been ridden it can no longer be returned as new, and any fault is handled under the manufacturer's warranty instead.

Opened helmets and protective gear, opened accessories, items showing wear or damage, and items modified from factory condition cannot be returned. Transit damage, dead-on-arrival faults and items shipped in error must be reported within 12 hours of delivery.

Refunds are issued to the original payment method after the returned item has been received and inspected, normally within 5 to 7 business days, and may take longer to appear depending on your bank. Every electric scooter and electric bike we sell is covered by its manufacturer's limited warranty against defects in materials and workmanship, running from the delivery date. Terms differ by brand and by component; on most brands the frame and motor are covered for 12 months and the battery and charger for shorter periods. The exact terms by brand are on our Warranty page.

The warranty is provided by the manufacturer, not by Speedway Riders. As the authorized dealer we file and manage the claim for you, but the manufacturer makes the final decision on every claim. Warranties do not cover wear items such as tires, tubes and brake pads, cosmetic damage, crash or accident damage, water damage beyond the product's IP rating, overloading, neglect, use of a non-approved charger, or any product that has been modified, unlocked, opened or repaired by anyone other than the manufacturer or its authorized service partner. Any of those may void the warranty entirely.

Some manufacturers require registration within a set period after purchase. Where that applies it is noted on the Warranty page, and failing to register can result in a valid claim being refused.

To the extent permitted by law, the manufacturer's warranty is the only warranty that applies to a product, and Speedway Riders gives no separate warranty of its own.

Electric scooters and electric bikes are motor vehicles that travel at speed, and riding one carries an inherent risk of serious injury or death to you and to others. By purchasing and riding you accept that risk and take responsibility for how the product is used.

The rules for where and how an electric scooter or electric bike may be ridden, who may ride one, whether a helmet, licence, registration or insurance is required, and what speed and power are permitted on public roads vary by state, county and city and change often. It is your responsibility to know and follow the laws where you ride. We cannot advise on the legality of any product in your area, and listing a product on the Site is not a representation that it is legal to ride on public roads where you live.

Many of the products we sell have riding modes that exceed the speed permitted on public roads. Those modes are intended solely for use on private property or closed courses with the landowner's permission. Selecting an appropriate mode for public roads and complying with local speed limits is entirely your responsibility.

Always wear a helmet and appropriate protective gear. Read the manufacturer's user manual before your first ride, check brakes, tires and folding mechanisms before every ride, observe the maximum rider weight, and do not ride under the influence of alcohol or drugs, when tired or unwell, or in conditions the product is not rated for.

Lithium-ion batteries must be charged with the charger supplied by the manufacturer, on a hard non-flammable surface, away from exits and never unattended overnight, and stored partly charged if the product will not be used for a while. Do not use a battery or charger that is damaged, swollen or has been submerged. Modifying, unlocking or repairing any electrical component yourself is dangerous and voids the warranty.

Speedway Riders NYC is not liable for any fires, accidents, injuries, or property damage arising from the use, storage, or modification of any product sold or recommended on this site. All products are manufactured by third parties, and any claims related to product defects, safety, or performance are the sole responsibility of the respective manufacturer. Please follow all manufacturer instructions and safety guidelines.

This applies to every electric scooter, electric bike, battery, charger, part and accessory we sell, whether the product was used as intended or otherwise, and it applies alongside the manufacturer warranty, the disclaimer of warranties and the limitation of liability set out in these Terms. Where a defect is suspected, the route is a warranty claim to the manufacturer, which we will help you file.

You may create an account to track orders and save details. You are responsible for keeping your login details confidential and for everything done under your account. Tell us immediately if you believe it has been accessed without your permission. We may suspend or close an account that breaches these Terms.

Where the Site allows you to post reviews, questions, photographs or other content, you grant Speedway Riders a worldwide, royalty-free, perpetual licence to use, reproduce, edit and display that content in connection with the Site and our marketing, and you confirm that you own it or have permission to post it. Content must be honest, based on your own experience, and must not be unlawful, defamatory, infringing, or contain personal information about others. We may remove any content at our discretion. Reviews are opinions of their authors and do not represent our views.

The Site and everything on it, including text, page layouts, graphics, photographs, video, code and the Speedway Riders name and logo, are owned by or licensed to Speedway Riders and protected by copyright, trademark and other laws. You may view and print pages for your own personal, non-commercial use. You may not otherwise copy, reproduce, scrape, republish, distribute or create derivative works from any part of the Site without our written permission.

Brand names, product names and logos of the manufacturers we carry belong to those manufacturers. They appear on the Site to identify genuine products sold by an authorized dealer and do not imply any other affiliation or endorsement.

You agree to use the Site only for lawful purposes and not to interfere with its operation, attempt to gain unauthorised access to any part of it, introduce malicious code, use automated tools to extract data, or place orders you do not intend to complete.

The Site links to third-party sites and services, including manufacturers' sites, carriers' tracking pages, payment processors and financing providers. Those sites have their own terms and privacy policies, we do not control them, and we are not responsible for their content or practices. Our Privacy Policy explains how we handle the personal information we collect from you.

The Site and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, Speedway Riders disclaims all warranties of any kind regarding the Site, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Site will be uninterrupted, error-free or secure, or that any description, price or specification is accurate or complete.

Products are covered by the manufacturer's warranty described above and, to the extent permitted by law, that warranty is in place of all other warranties, express or implied, including any implied warranty of merchantability or fitness for a particular purpose. Some states do not allow the exclusion of implied warranties, so some of the above may not apply to you.

To the fullest extent permitted by law, Speedway Riders and its owners, employees, agents and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data or use, arising out of or in connection with the Site, these Terms, or any product purchased through the Site, however caused and under any theory of liability, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to a product or order will not exceed the amount you paid us for that product. Our total liability for any claim relating to the Site generally will not exceed one hundred US dollars.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by our negligence or for fraud. Some states do not allow the limitation of certain damages, so some of the above may not apply to you.

You agree to defend, indemnify and hold harmless Speedway Riders and its owners, employees and agents from and against any claims, damages, losses, liabilities, costs and expenses, including reasonable attorneys' fees, arising out of or relating to your use of the Site, your breach of these Terms, your violation of any law or the rights of a third party, or your use or misuse of any product purchased through the Site, including any injury to you or to others.

These Terms and any dispute arising out of or relating to them, the Site or any order are governed by the laws of the State of Texas, without regard to its conflict-of-law rules, and by applicable federal law.

If you have a problem, please contact us first at info@speedwayridersnyc.com and give us 30 days to resolve it informally. Most issues are settled this way.

If we cannot resolve a dispute informally, you and Speedway Riders agree that it will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small claims court where it qualifies. The arbitration will take place in Travis County, Texas, or by video or telephone, or in your county of residence if you prefer. The arbitrator's decision is final and may be entered as a judgment in any court of competent jurisdiction.

You and Speedway Riders each agree that disputes will be brought only on an individual basis and not as a plaintiff or class member in any purported class, collective or representative proceeding, and that the arbitrator may not consolidate more than one person's claims. If this class-action waiver is found unenforceable for a particular claim, that claim will be heard in the state or federal courts located in Travis County, Texas, and you consent to their jurisdiction.

You may opt out of this arbitration agreement by emailing info@speedwayridersnyc.com within 30 days of your first order with your name, order number and a clear statement that you opt out. Opting out does not affect any other part of these Terms.

We are not liable for any delay or failure to perform caused by events outside our reasonable control, including carrier disruption, supplier or manufacturer delays, weather, strikes, epidemics, government action or failures of infrastructure.

If any part of these Terms is found to be invalid or unenforceable, the rest remains in full effect. Our failure to enforce any provision is not a waiver of our right to enforce it later. You may not assign or transfer these Terms or any order without our consent; we may assign them in connection with a merger, acquisition or sale of the business. These Terms, together with the policies they incorporate and any order confirmation, are the entire agreement between you and Speedway Riders on their subject matter and replace any earlier terms.

We may update these Terms from time to time. The date at the top of this page shows when they last changed. Changes apply to orders placed after they are posted; the terms in force when you placed an order continue to apply to that order. Continuing to use the Site after a change means you accept the updated Terms.
