Terms of service
The terms that apply when you use speedwayridersnyc.com or buy an electric scooter, electric bike, part or accessory from us. They are written to be read, and the short version comes first.
What you are agreeing to
The full terms below are what count. This is an honest summary of the parts that come up most often.
You need to be 18 or older, with a delivery address in the 48 contiguous states. Your confirmation email means we have your order; we accept it when we ship it. If a price or listing is plainly wrong, we tell you and refund you rather than ship it.
Cards and the other payment methods shown at checkout, plus financing through Affirm, Klarna and Afterpay. The provider decides eligibility, rates and terms, and the limits are shown at checkout.
Free shipping on every order to the 48 contiguous states, by FedEx or UPS. Delivery dates are estimates. The item is yours, and so is the risk, once it is delivered, so check it as soon as it arrives and tell us straight away about any damage.
Fourteen days from delivery to start a return of an unused item in its original packaging. Get in touch first. Once a ride has been ridden, a fault is handled under the manufacturer’s warranty instead.
Covered by the manufacturer’s warranty; the terms vary by brand and by part, and the manufacturer decides each claim. If something goes wrong we help you raise the claim and follow it up.
You are responsible for riding legally and safely: local laws, a helmet, the right riding mode for public roads. Speedway Riders is not liable for fires, accidents, injuries or property damage arising from the use, storage or modification of any product; defect and safety claims rest with the manufacturer.

Agreement to these terms
These Terms of Service (the “Terms”) are a binding agreement between you and Speedway Riders NYC (“Speedway Riders”, “we”, “us” or “our”), an online retailer of electric scooters, electric bikes, parts and accessories based in Brooklyn, New York. They govern your use of speedwayridersnyc.com (the “Site”) and every purchase you make through it.
By using the Site, creating an account or placing an order, you confirm that you have read these Terms, understand them and agree to be bound by them, together with our Privacy Policy, Cookie Policy, Shipping Policy, Returns and Exchanges Policy and Warranty page, each of which forms part of these Terms. If you do not agree, please do not use the Site or place an order.
We sell online only. There is no store to visit, orders cannot be collected in person, and nothing on the Site should be read as an invitation to visit an address.
Who can buy
You must be at least 18 years old and able to enter into a binding contract to place an order. By ordering you confirm that you are. If you are buying an electric scooter or electric bike for a younger rider, you are responsible for choosing a model that suits their age and size, for supervising its use and for making sure it is ridden legally.
We deliver to addresses in the 48 contiguous United States. Orders with billing or delivery details outside that area, or that we cannot verify, may be cancelled and refunded.
We may refuse, limit or cancel any order at our discretion, including where we suspect fraud or a breach of these Terms. If we do, any payment you have made is refunded in full.
Products, descriptions and availability
Product names, specifications, images and descriptions come from the manufacturers and are reproduced in good faith, but we do not guarantee that every listing is complete, current or free of error.
Figures such as top speed, range, motor power, climbing grade and weight capacity are the manufacturer’s ratings, measured under the manufacturer’s own test conditions. Real-world results depend on rider weight, terrain, temperature, riding mode, tire pressure and battery age, and will usually be lower. Range in particular varies widely and should be read as a maximum, not a promise.
Colors can look different on screen than in person, and manufacturers change components, firmware and cosmetic details between production runs without notice. Where a change is material we tell you before shipping and give you the option to cancel.
All products are subject to availability. If an item you have ordered is unavailable or discontinued, we contact you with the option of a comparable model, a wait, or a full refund.
Pricing, promotions and errors
All prices are in US dollars and do not include sales tax, which is calculated and shown at checkout. We may change prices at any time, but a change does not affect an order we have already accepted.
Sale prices, coupon codes and promotions are valid only for the period and on the terms stated, cannot be applied to earlier orders, and cannot be combined unless we say so. Codes must be applied at checkout before the order is placed; we cannot apply them afterwards. We may withdraw or change a promotion at any time.
Despite our care, a listing may occasionally carry a wrong price or description. If we find an error in an order you have placed, we contact you with the correct information and the choice to go ahead at the correct price or cancel for a full refund. Where a price is so obviously wrong that a reasonable person would recognise it as a mistake, we may cancel the order and refund you without contacting you first.
Orders, acceptance and cancellation
When you place an order you receive an email confirming that we have received it. That email is an acknowledgement, not an acceptance. We accept your order, and the contract between us is formed, when we ship the item and send you a shipping confirmation. Until then we may decline the order for any reason set out in these Terms, and we refund any payment taken.
We may verify your identity, payment method or address before accepting an order and may ask you for supporting information. If we cannot complete verification within a reasonable time, the order may be cancelled.
If you need to cancel an order, contact us as soon as possible. If it has not been packed yet we can normally cancel it and refund you. Once an item has shipped it cannot be cancelled; it can be returned under the Returns and Exchanges Policy if it qualifies.
Payment and financing
We accept major credit and debit cards and the other payment methods shown at checkout. By submitting a payment method you confirm that you are authorized to use it. Payment is taken when the order is placed. Card details are handled by our payment processor and are never stored by us.
Financing is offered at checkout through Affirm, Klarna and Afterpay. Each is an independent provider, not part of Speedway Riders. Your eligibility, the plans offered, any interest rate, the amounts that can be financed and every other term of a financing agreement are set by the provider and governed by that provider’s own agreement with you, which you should read before accepting. We do not make credit decisions and cannot change a provider’s decision or terms. See Financing for how the options work.
When a financed order is returned, the refund goes back through the financing provider, which then adjusts or cancels your plan under its own terms. You remain responsible to the provider for any payment that falls due before that adjustment is made.
Shipping and delivery
Shipping is free on every order to the 48 contiguous United States. Orders are typically processed within 1 to 2 business days of payment confirmation, longer during major sales and holidays, and ship by FedEx or UPS. Delivery dates are estimates, not guarantees, and carrier delays, weather and address problems are outside our control. Full details are in our Shipping Policy.
You are responsible for giving us a complete and accurate delivery address. If an order comes back to us because of an address error, a refused delivery or repeated failed delivery attempts, we contact you about reshipping it or refunding it under the Returns and Exchanges Policy.
Title to and risk of loss for an item pass to you when the carrier delivers it to the address you gave us. Please check the outer packaging on delivery and the contents as soon as you can. If anything arrives damaged, missing or will not power up, tell us straight away with photographs of the box and the item, and keep all the packaging. Please accept a damaged delivery and document it rather than refusing it, unless we have told you otherwise.
Returns and exchanges
You have 14 days from delivery to start a return or exchange of an unused, unridden electric scooter or electric bike in its original packaging with all accessories and paperwork, or of a helmet, part or accessory that is still sealed. Contact us first: we give you an RMA number so the return can be matched to your order, and you can start from our Start a return page. Once an item has been ridden it can no longer be returned as new, and a fault is handled under the manufacturer’s warranty instead.
Opened helmets and protective gear, opened accessories, items showing wear or damage, and items modified from factory condition cannot be returned. An item that arrives damaged or faulty, or that is not what you ordered, is ours to put right; tell us as soon as it arrives.
Refunds go back to the original payment method once the returned item has arrived and been checked. How quickly the money then appears depends on your bank, card issuer or financing provider. Manufacturer warranty
Products are covered by their manufacturer’s warranty where the manufacturer provides one. What it covers, for how long, and what the manufacturer needs from you are set by the manufacturer and vary by brand, by model and by part. Our Warranty page explains how it usually works.
The warranty is provided by the manufacturer, not by Speedway Riders, and the manufacturer decides every claim. If something goes wrong, we help you raise the claim and follow it up; you can start from our Warranty claim page.
Manufacturers’ warranties commonly exclude wear items such as tires, tubes and brake pads, cosmetic damage, crash or accident damage, water damage, overloading, neglect and the use of a charger the manufacturer has not approved. Manufacturers can refuse a claim for damage caused by opening, modifying or unlocking a product.
Some manufacturers ask you to register a product after purchase. The product’s manual and the manufacturer’s website say whether that applies; if it does, please register, because a manufacturer can refuse a claim on an unregistered product.
To the extent permitted by law, the manufacturer’s warranty is the only warranty that applies to a product, and Speedway Riders gives no separate warranty of its own.
Rider responsibility and safety
Electric scooters and electric bikes are motor vehicles that travel at speed, and riding one carries an inherent risk of serious injury or death to you and to others. By buying and riding you accept that risk and take responsibility for how the product is used.
The rules for where and how an electric scooter or electric bike may be ridden, who may ride one, whether a helmet, licence, registration or insurance is required, and what speed and power are allowed on public roads vary by state, county and city and change often. It is your responsibility to know and follow the laws where you ride. We cannot advise on the legality of any product in your area, and listing a product on the Site is not a statement that it is legal to ride on public roads where you live.
Many of the products we sell have riding modes that exceed the speed allowed on public roads. Those modes are intended only for use on private property or closed courses with the landowner’s permission. Choosing an appropriate mode for public roads and keeping to local speed limits is entirely your responsibility.
Always wear a helmet and appropriate protective gear. Read the manufacturer’s manual before your first ride, check the brakes, tires and folding mechanism before every ride, keep to the maximum rider weight, and do not ride under the influence of alcohol or drugs, when tired or unwell, or in conditions the product is not rated for.
Charge lithium-ion batteries only with the charger supplied by the manufacturer, on a hard, non-flammable surface, away from exits and never unattended overnight, and store them partly charged if the product will not be used for a while. Do not use a battery or charger that is damaged, swollen or has been submerged. Modifying, unlocking or repairing any electrical component yourself is dangerous, and manufacturers can refuse a claim for damage it causes.
Product liability disclaimer
Speedway Riders NYC is not liable for any fires, accidents, injuries, or property damage arising from the use, storage, or modification of any product sold or recommended on this site. All products are manufactured by third parties, and any claims related to product defects, safety, or performance are the sole responsibility of the respective manufacturer. Please follow all manufacturer instructions and safety guidelines.
This applies to every electric scooter, electric bike, battery, charger, part and accessory we sell, whether the product was used as intended or otherwise, and it applies alongside the manufacturer’s warranty, the disclaimer of warranties and the limitation of liability in these Terms. Where a defect is suspected, the route is a warranty claim to the manufacturer, which we help you raise.
Accounts, reviews and your content
You may create an account to track orders and save your details. You are responsible for keeping your login details confidential and for everything done under your account. Tell us straight away if you think it has been used without your permission. We may suspend or close an account that breaches these Terms.
Where the Site lets you post reviews, questions, photographs or other content, you grant Speedway Riders a worldwide, royalty-free, perpetual licence to use, reproduce, edit and display that content in connection with the Site and our marketing, and you confirm that you own it or have permission to post it. Content must be honest and based on your own experience, and must not be unlawful, defamatory or infringing or contain other people’s personal information. We may remove content that breaks these rules. Reviews are the opinions of their authors, not ours.
Intellectual property
The Site and everything on it, including text, page layouts, graphics, photographs, video, code and the Speedway Riders name and logo, are owned by or licensed to Speedway Riders and protected by copyright, trademark and other laws. You may view and print pages for your own personal, non-commercial use. You may not otherwise copy, reproduce, scrape, republish, distribute or create derivative works from any part of the Site without our written permission.
The brand names, product names and logos of the manufacturers whose products we sell belong to those manufacturers. They appear on the Site to identify the products and do not imply any other affiliation with or endorsement by those manufacturers.
Using the Site and third-party links
You agree to use the Site only for lawful purposes and not to interfere with how it works, try to gain unauthorised access to any part of it, introduce malicious code, use automated tools to extract data, or place orders you do not intend to complete.
The Site links to third-party sites and services, including manufacturers’ sites, carriers’ tracking pages, payment processors and financing providers. They have their own terms and privacy policies, we do not control them, and we are not responsible for their content or practices. Our Privacy Policy explains how we handle the personal information we collect from you.
Disclaimer of warranties
The Site and its content are provided “as is” and “as available”. To the fullest extent permitted by law, Speedway Riders disclaims all warranties of any kind about the Site, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title and non-infringement. We do not warrant that the Site will be uninterrupted, error-free or secure, or that any description, price or specification is accurate or complete.
Products are covered by the manufacturer’s warranty described above and, to the extent permitted by law, that warranty is in place of all other warranties, express or implied, including any implied warranty of merchantability or fitness for a particular purpose. Some states do not allow the exclusion of implied warranties, so some of the above may not apply to you.
Limitation of liability
To the fullest extent permitted by law, Speedway Riders and its owners, employees, agents and suppliers are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, data or use, arising out of or in connection with the Site, these Terms or any product bought through the Site, however caused and under any theory of liability, even if we have been told such damages were possible.
Our total liability to you for any claim arising out of or relating to a product or order will not exceed the amount you paid us for that product. Our total liability for any claim relating to the Site generally will not exceed one hundred US dollars.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by our negligence, or for fraud. Some states do not allow the limitation of certain damages, so some of the above may not apply to you.
Indemnification
You agree to defend, indemnify and hold harmless Speedway Riders and its owners, employees and agents from and against any claims, damages, losses, liabilities, costs and expenses, including reasonable attorneys’ fees, arising out of or relating to your use of the Site, your breach of these Terms, your violation of any law or the rights of a third party, or your use or misuse of any product bought through the Site, including any injury to you or to others.
Governing law and dispute resolution
These Terms and any dispute arising out of or relating to them, the Site or any order are governed by the laws of the State of New York, without regard to its conflict-of-law rules, and by applicable federal law.
If you have a problem, please contact us first at info@speedwayridersnyc.com and give us 30 days to resolve it informally. Most issues are settled this way.
If we cannot resolve a dispute informally, you and Speedway Riders agree that it will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either of us may bring an individual claim in small claims court where it qualifies. The arbitration will take place in the county where you live, or by video or telephone if you prefer. The arbitrator’s decision is final and may be entered as a judgment in any court with jurisdiction.
You and Speedway Riders each agree that disputes will be brought only on an individual basis and not as a plaintiff or class member in any class, collective or representative proceeding, and that the arbitrator may not consolidate more than one person’s claims. If this class-action waiver is found unenforceable for a particular claim, that claim will be heard in the state or federal courts located in the State of New York, and you consent to their jurisdiction.
You may opt out of this arbitration agreement by emailing info@speedwayridersnyc.com within 30 days of your first order with your name, your order number and a clear statement that you opt out. Opting out does not affect any other part of these Terms.
General terms
We are not liable for any delay or failure to perform caused by events outside our reasonable control, including carrier disruption, supplier or manufacturer delays, weather, strikes, epidemics, government action or failures of infrastructure.
If any part of these Terms is found to be invalid or unenforceable, the rest remains in full effect. Our failure to enforce any provision is not a waiver of our right to enforce it later. You may not assign or transfer these Terms or any order without our consent; we may assign them in connection with a merger, acquisition or sale of the business. These Terms, together with the policies they include and any order confirmation, are the entire agreement between you and Speedway Riders on their subject and replace any earlier terms.
We may update these Terms from time to time. The date in the index shows when they last changed. Changes apply to orders placed after they are posted; the terms in force when you placed an order continue to apply to that order. Continuing to use the Site after a change means you accept the updated Terms.
